Terms of Service

These terms are an agreement between you and StitchSwift (“we”, “us”) covering your use of this site and our embroidery digitizing service. By creating an account or using the service you agree to them. If you do not agree, please do not use the service.

1. The service

StitchSwift converts artwork you upload into machine embroidery files — PES and DST machine files, the editable SVG, a stitch preview, a thread list and a validation report — which are delivered as one production package. Processing is automated. You choose the machine, hoop, fabric, colour limit and target size when you submit a design, and you can review the result before approving it.

The service is in beta. Features, pricing and output quality are still changing, and we may alter or withdraw features with reasonable notice.

2. Your account

You sign in with a supported identity provider, currently Google. One account owns one workspace, and everything created in that workspace belongs to it. You are responsible for activity under your account; keep your sign-in method secure and tell us at [email protected] if you suspect misuse.

3. Credits and payment

4. Your artwork and your rights

You keep every right you already hold in the artwork you upload, and you own the embroidery files we generate from it. You confirm at submission that you have permission to use the artwork, and that confirmation is recorded with the job. Do not upload work you have no right to reproduce — trademarks, logos and licensed characters belonging to others included.

We use your artwork only to run the service for you. We do not use it to train models, build a template library, or show it to anyone else. We may remove content and suspend an account that is being used to infringe someone’s rights or to break the law.

5. What we do not promise

Digitizing is an approximation of artwork in thread. We show you the stitch plan, the validation checks and the thread list so you can judge the result before committing material, but we cannot promise that any design will sew perfectly on your machine, your stabiliser and your fabric. Test-stitch before production.

The service is provided as is, without warranties of merchantability or fitness for a particular purpose. To the extent the law allows, our total liability for any claim relating to the service is limited to what you paid us in the three months before the claim, and we are not liable for lost profits, lost material, or indirect or consequential loss.

6. Acceptable use

Do not attempt to disrupt the service, access another workspace’s data, or use the service to produce unlawful, hateful or infringing material. We may suspend accounts that do.

7. Ending the agreement

You may stop using the service and ask us to close your account at any time. You can delete individual designs from your workspace, which removes the artwork and generated files. We may suspend or end an account for a breach of these terms, and will tell you why where we reasonably can.

8. Changes

If these terms change materially we will post the new version here and update the date above. Continuing to use the service after that means you accept the change.

9. Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong SAR have exclusive jurisdiction over any dispute arising from them.
